Rental Terms & Conditions

1. Parties & Scope

Castelier (“the Platform”) is operated by Mobemos Hub SL (trading as Castelier Mobility), Marbella, Málaga, Spain — contact castelier@mobemos.com. The Platform technology is owned and provided by Organiq Sweden AB; Organiq is not a party to any rental agreement and has no contractual relationship with customers.

Castelier rents out vehicles from its own fleet and vehicles owned by third parties. Where a vehicle is owned by a third party, Mobemos Hub SL rents it to you in its own name, for the account of the vehicle’s owner (comisión mercantil, arts. 244–246 of the Spanish Commercial Code). In every case, Mobemos Hub SL is your contractual counterparty and is responsible to you for the rental. The ownership of the vehicle does not affect your rights under these terms or under Spanish law.

By completing a booking you accept these terms.

Version. These terms may be amended from time to time. The version in force at the moment your booking is confirmed is the version that governs that rental. Amendments do not apply retroactively to bookings already confirmed. The version identifier and its effective date are shown at the top of this page.

2. Driver Requirements

The minimum driver age applies per vehicle and is shown on each vehicle’s booking page (typically 21–25, depending on category). Drivers below 25 may be subject to a young-driver surcharge where indicated.

All drivers must hold a valid driving licence held for at least 12 months. For non-EU/EEA licences, an International Driving Permit may be required.

At handover, the driver must present a valid driving licence, a passport or national ID, and a payment card in the main driver’s name. Additional drivers must be declared and registered before driving.

3. Booking & Payment

Rental charges are paid online at the time of booking via our payment processor, Stripe. A booking is confirmed once payment is successfully processed and you receive a confirmation email.

Identity and document verification (KYC) is completed at or before handover. The lessor reserves the right to refuse handover if the driver does not meet the requirements in Section 2 or fails verification, in which case the cancellation and refund terms in Section 8 apply.

4. Security Deposit

In addition to the rental price, a security deposit (fianza) is required. The deposit is not part of the rental price and is not a charge: it is taken at or shortly before handover as security, and released after the vehicle is returned and inspected, subject to any deductions for charges incurred.

The deposit amount applicable to your booking is shown on the vehicle’s booking page, at checkout and in your confirmation. It secures the applicable excess (Section 5) and any additional charges that may arise during the rental — for example fuel, excess mileage (Section 6), late return, traffic penalties, or damage.

The method by which the deposit is taken (card pre-authorisation or another agreed means) is confirmed at handover. Where it is taken as a card pre-authorisation, the amount is blocked rather than charged, and reduces your available card limit for the duration of the rental. Release timing depends on your bank.

5. Protection & Excess

Standard cover is included with every rental, at no cost. It comprises third-party liability insurance (compulsory by law), 24/7 roadside assistance, and damage cover subject to an excess.

The excess is the maximum amount you are liable to pay if the vehicle is damaged. It is set per vehicle and is shown on the vehicle’s booking page, at checkout, and in your rental agreement. The excess is separate from, and secured by, the deposit (Section 4).

Deposit Flex (optional). Where offered for a vehicle, Deposit Flex may be purchased at checkout for a daily fee, capped per booking. It reduces both the deposit and the excess to the lower amounts shown at checkout for that vehicle. The fee is part of the rental price and is not refundable on return. Deposit Flex reduces the excess; it does not remove it. An excess always remains payable in the event of damage. Deposit Flex is not available on every vehicle.

Exclusions may apply — for example interior damage, gross negligence, driving under the influence, unauthorised drivers, use outside the terms of Section 12, or breach of these terms. In such cases you may be liable beyond the excess, up to the full value of the damage. The applicable excess and the exclusions are shown at booking and set out in the rental agreement.

6. Mileage

Each vehicle carries a mileage allowance, shown on its booking page and at checkout — either a daily allowance in kilometres, or unlimited mileage where expressly stated.

Where a vehicle has a mileage allowance, kilometres driven in excess of it are charged at the excess-mileage rate shown for that vehicle. The rate differs between vehicles.

Mileage is recorded from the odometer at handover and at return, and the readings are part of the condition record described in Section 10. Any excess-mileage charge is calculated from those readings and may be deducted from the deposit.

7. Delivery & Collection Zones

Delivery and collection are offered within defined zones:

Zone 1 (Marbella, Golden Mile, Puerto Banús, San Pedro, Elviria and surrounding areas): complimentary.

Zone 2 (Estepona, Mijas Costa, Fuengirola): a delivery fee applies unless otherwise indicated for the vehicle.

Zone 3 (Málaga, Sotogrande, Gibraltar, Nerja and beyond): on request.

Delivery details, including any applicable fee, are confirmed at checkout. The vehicle must be available for collection at the agreed location and time at the end of the rental.

8. Cancellation & No-Show

The Standard booking is non-refundable. Once the booking is confirmed and paid, the rental price is not refunded if you cancel, change the dates, or do not appear at the agreed handover. This is stated at checkout before payment.

Flexible booking (optional). Where purchased at checkout for a daily fee, capped per booking, you may cancel or change the booking free of charge up to 24 hours before the agreed handover. Cancellations or changes made later than that, and no-shows, are treated as a Standard booking and are not refunded. The Flexible booking fee itself is not refunded in any case.

Refunds, where due, are processed to the original payment method. Nothing in this section affects your statutory rights, including any right to a remedy where we fail to provide the vehicle.

9. Vehicle Availability & Substitution

We make every reasonable effort to provide the exact vehicle you booked. If that vehicle is not available at handover — for example because of damage caused during a previous rental, mechanical breakdown, theft, or a similar event — we will offer you either:

(a) a comparable or superior vehicle at no additional charge; or

(b) — notwithstanding Section 8 — a full refund of all amounts paid for the booking.

If you accept a substitute vehicle of a lower category, the price difference is refunded. Our liability for unavailability is limited to the amounts paid for the booking. Nothing in this section limits liability that cannot be excluded or limited under Spanish consumer law.

10. Vehicle Condition & Damage Evidence

The vehicle is delivered in documented condition. At handover and return, the vehicle’s condition is recorded photographically. These photographs are stored with a cryptographic integrity record (SHA-256) and form a tamper-evident evidence chain used to fairly resolve any dispute over damage.

The renter is responsible for the vehicle during the rental period and must report any damage or incident immediately using the damage-report link provided with the booking. Damage assessment is based on the documented condition at handover versus return.

11. Fuel Policy

Vehicles are supplied full-to-full: delivered with a full tank and to be returned with a full tank. A refuelling charge plus a service fee applies if the vehicle is returned with less fuel than at handover.

12. Use of the Vehicle

The vehicle must be driven in compliance with the Spanish Highway Code and all applicable traffic and parking rules. The vehicle may not be taken outside Spain without prior written authorisation from the lessor, used to transport dangerous goods, used on race tracks or circuits or in any motor-sport or timed event, used for towing or pushing, used for driving tuition, driven off public roads or on unpaved surfaces unless expressly permitted in writing, used to carry passengers for hire or reward, sub-let, used for any unlawful purpose, or driven by any person not registered on the rental agreement.

Traffic fines and penalties incurred during the rental are the renter’s responsibility. Where an authority requests identification of the driver, the lessor will provide the renter’s details as required by law, and an administrative handling fee may apply.

13. Legal Registration (RD 933/2021 — SES)

Spanish law (Real Decreto 933/2021) requires vehicle rental operators to register and report certain renter and vehicle data to the Ministry of the Interior (Dirección General de la Policía) via the SES.HOSPEDAJES platform, within 24 hours of the booking and at the start and end of the rental.

This legal obligation is handled by Mobemos Hub SL as the renting operator. Reported data (name, document type and number, nationality, date of birth, address, and vehicle details) is retained as required by law (three years) and handled in accordance with our Privacy Policy.

14. Liability

Mobemos Hub SL is responsible to you for the performance of the rental agreement in accordance with these terms and applicable law, for all vehicles rented through Castelier. Nothing in these terms excludes or limits liability that cannot be excluded or limited under Spanish consumer law.

15. Force Majeure

Neither party is liable for a failure or delay in performing its obligations under these terms caused by events beyond its reasonable control, including natural disasters, fire, flood, strikes, airport or road closures, war, civil unrest, governmental restrictions, or failures of public infrastructure. If such an event prevents us from providing the vehicle, Section 9 applies and you are entitled to a substitute vehicle or a full refund. This section does not affect your statutory rights.

16. Data Protection

Personal data is processed in accordance with our Privacy Policy, Regulation (EU) 2016/679 (GDPR), and Spain’s Ley Orgánica 3/2018 (LOPDGDD).

17. Governing Law & Jurisdiction

These terms are governed by Spanish law. Disputes are subject to the competent courts of Spain, without prejudice to any mandatory consumer protections available to you under the law of your country of residence.
